These Terms of Service govern your use of the Indicalert website and app (the "Service"). By creating an account or using the Service you agree to them and to our Privacy Policy.
1. Who can use Indicalert
You must be at least 18 years old and able to form a binding contract. You need an account to use most features. Keep your login details confidential: you are responsible for everything that happens under your account, and you must tell us promptly if you suspect unauthorised access.
2. The service
Indicalert lets you build alerts from technical indicators, price levels and drawn lines, scan and backtest strategies, and receive notifications on Telegram. Features, limits and plans may change over time.
3. Plans, billing and cancellation
Some features are free. Paid plans are recurring subscriptions billed through Stripe at the price and interval shown at checkout. Each plan has limits, for example on the number of alerts, AI reports and AI chat messages, and on access to custom scanner strategies; these limits are shown on the pricing page and in your account.
Your subscription renews automatically until you cancel. You can cancel at any time from the Subscription page of your account; the cancellation takes effect at the end of the period you have already paid for. Refunds are covered by our Refund Policy.
4. Acceptable use
You agree not to:
- break the law or infringe anyone's rights;
- interfere with or disrupt the Service or its servers, or try to gain unauthorised access to it or to other users' accounts;
- send automated or excessive requests, scrape the Service, or use it to build a competing product or data feed;
- resell, sublicense or share your account or access with others;
- copy, reverse engineer or create derivative works from the Service, except as the law allows.
We may suspend or end access to anyone who breaks these rules.
5. Alerts, data and availability
Alerts are evaluated when a candle closes on the timeframe you chose, using market data from third-party sources. That data can be delayed, incomplete, stale or wrong, and notifications depend on third-party services such as Telegram. The same applies to economic calendar data (release times, published figures and the measured market reactions), which comes from public sources and can be delayed, corrected or revised. We do not guarantee that an alert will trigger, trigger on time, or be delivered. The Service may be interrupted for maintenance or because of faults outside our control.
6. Not investment advice
Indicalert is a monitoring and analysis tool. Nothing on the website or in the app, including alerts, scanner results, backtests and AI reports, is investment, financial, legal or tax advice, or an offer or recommendation to buy or sell anything. Trading cryptocurrency is risky and you can lose all of the money you put in. You make your own decisions and bear all of the risk of them. Do your own research and consider speaking to a licensed professional before you trade.
Backtesting. The backtesting tools estimate how a strategy would have performed on historical data under simplified assumptions, such as a liquid market and orders executed at the modelled prices, and they may contain errors caused by the underlying data or calculations. Past performance does not predict future results.
AI features. AI reports and chat replies are generated automatically, are experimental, and can be inaccurate or incomplete. Treat them as one input among many.
7. Your content
You keep ownership of what you create in the app, such as your alerts, drawings and notes. You give us permission to store and process it to provide the Service to you.
8. Our intellectual property
The Service, including its software, design, text and branding, belongs to Indicalert or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use it for your own personal use while you comply with these Terms. All other rights are reserved.
9. Termination
You can stop using the Service and ask us to delete your account at any time (see the Privacy Policy). We may suspend or end your access if you break these Terms, if we must do so by law, or if we stop offering the Service.
10. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, INDICALERT, ITS AFFILIATES, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA OR TRADING OPPORTUNITIES, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING A MISSED, LATE OR INCORRECT ALERT. Nothing in these Terms limits liability that cannot be limited by law.
12. Severability
If any part of these Terms is found to be unenforceable, it will be modified to the minimum extent needed to make it enforceable and the rest of the Terms will stay in effect.
13. Governing law
These Terms and any dispute arising from them or from the Service are governed by the laws of the United States, without regard to conflict-of-law rules. Mandatory consumer protection laws of the country where you live still apply to you.
14. Changes to these Terms
We may update these Terms. We will post the new version here with a new "last updated" date and, for significant changes, try to notify you as well. If you keep using the Service after a change takes effect, you accept the updated Terms.
